Returns & Exchanges
All returns and exchanges must be submitted/reported to The Vault Pro Scooters within 30 days of receiving your merchandise. The 30-day period begins when merchandise is delivered to recipient's shipping address. *Please check undergarment policy at the bottom of this page, especially prior to ordering*
Return procedures may vary by product, therefore it is important that you contact us for proper return shipping procedures and instruction. The Vault Pro Scooters will NOT be held liable for any returns done without proper authorization. Any item/product that has been altered, modified or has surpassed the allotted return shipping period will NOT be eligible for a refund, exchange or return.
Upon completion of an approved return, a pre-paid return shipping label will be generated for the customer via our website. A standard return shipping rate will be deducted from any and all returns, unless otherwise advised by an authorized Vault Pro Scooters employee.
Returned items must be in new condition and in it’s original packaging in order to receive full refund (excluding the return shipping fee). Be advised a 10% restocking fee will be applied to ANY returns not in original packaging but in brand new condition. If product is for an exchange, then the standard 10% restocking fee will be waived as a courtesy. If the Items received are damaged, worn or show signs of use/installation, depending on condition, a 10 - 20% damage fee may be deducted from your refund. If the condition of the product is in an "unsellable" state, your return will not be accepted.
We advise insuring your return with "Signature upon Delivery" to ensure your package arrives to the proper destination. This service is offered by most, if not all, shipping carriers. The Vault Pro Scooters is not responsible for any items lost or damaged during the return shipping process.
Holiday Extended Policy
We get it…Christmas present right? Most purchases made during the holidays are usually intended as gifts. The Vault also assumes packages will not be opened until after Christmas Day. Therefore, The Vault Pro Scooters has implemented a special Return/Exchange Policy just for the holidays. Any purchase made between November 1st and December 24th is permitted 30 days to report a return/exchange. The 30-day period begins Christmas Day, therefore, the last day to report a return/exchange would be January 25th (PST).
Damaged or Defective Products

Incorrect Product Shipping
If you received an incorrect item, please contact our customer service department. It is important that you contact us before making a return because you may or may not need to return the product. This will be determined on a case-by-case basis when you contact a representative from The Vault Pro Scooters.
Refunds
Refunds are issued within two business days of receiving any returned merchandise. Be advised it may take some time for refunded transactions to settle in your account. Be advised a 10% restocking fee will be applied to your return. For any return or exchange claim, shipping costs are non-refundable.
Patrons are responsible for all additional shipping charges necessary to complete a return or exchange.
Expedited Exchange
The Vault Pro Scooters will not send out any additional merchandise for exchange without first receiving the returned items. If you would like to advance your exchange process, you will need to place a second order for the desired items and return any items from the original order. The Vault Pro Scooters will then issue a refund for the returned items once they are received.
Undergarment Return Policy
Due to hygiene issues, we cannot accept any underwear and undergarments for returns or refunds. We highly recommend calling or messaging us directly to ensure you get the right size prior to finalizing an order. We will even switch them out for a better size should you have already submitted an order, but we cannot accept any articles once they have been fulfilled.

Payment Methods
The Vault Pro Scooters currently only accepts MasterCard, Visa, Amex, Discover and Paypal. Checks and money orders are not accepted at this time. No exceptions will be made. For a secured transaction, you are required to provide a correct billing address and security code to successfully process an online/phone order purchase. Be advised we offer an option to enter a separate billing and shipping address if needed. Both the billing and shipping address must be within the contiguous U.S.
California Sales Tax
The Vault Pro Scooters operates in the State of California. For these reasons, California customers are required to pay current sales tax set by Los Angeles County.
U.S. Only
The Vault Pro Scooters will only ship within the contiguous U.S. No exceptions may be made at this time.
The Vault Pro Scooters will not be held liable for damaged or defective items transported outside of the contiguous U.S. through an independent party.
Product Availability
Our team makes every effort to keep our site’s inventory updated but due to fluctuating supply we cannot always guarantee availability. If an item results to be out of stock or has an impending arrival date, you will be contacted via email or telephone by one of our representatives. Be advised your card is charged at time of purchase. You are welcomed to contact The Vault Pro Scooters during business hours to check for accurate availability prior to your purchase.
Thevaultproscooters.com permits customers to purchase items that are listed as “out of stock”. This item will be placed on backorder and will ship once it becomes available. Our product(s) return dates are only approximations. Be advised delays may occur.
Pricing
The Vault Pro Scooters strives to always preserve low prices. Be advised prices are subject to change at any time without notice due to dealer/manufacturer updates.
Product Warranty
The Vault Pro Scooters does not warranty scooters or parts. The Vault Pro Scooters facilitates customers warranties with the manufacture’s, within the manufactures warranty period. Product warranties may vary by manufacturer. Warranty is normally limited to replacement of defective parts with working parts of equal or greater value. Warranty coverage is offered at the discretion of the product manufacturer. The Vault Pro Scooters will facilitate a 15-day manufacturer warranty effective after purchase date. The patron is responsible for any warranty claims made after the 15-day period.
Broken scooters and decks due to impact are not considered defective, freestyle scootering is a action sport. If you attempt a trick it's possible to snap, crack or fracture a deck, any deck, and that is not covered under warranty. Inspect the entire scooter before you ride everyday. Bent bars due to impact are not warrantied at anytime. Scooter wheels often have problems when a rider lands sideways, after doing a trick such as a tailwhip or 360. The sideways impact of hard landings likes these, can cause even the best quality wheels to “chunk” or “dehub”. All warranties are facilitated by The Vault, but warrantied by the manufacture.
What IS covered under warranty:
1) The complete dehubbing of a wheel as a result of the failure of the urethane to stick to the core.
2) Any other failing of the wheel as a result of a manufacturing fault e.g. The core snapping or bending or the bearing hole ovalising (only if the bearings have been fitted professionally by the retailer)
3) Any failing of the urethane (If the urethane has chunked, split, cracked or dehubbed - FROM THE CORE TO OUTSIDE EDGE OF WHEEL)
What is NOT covered under warranty:
1) Any damage on the surface of the urethane, as this is caused by how the wheel is ridden & is not a manufacturing fault of the urethane.
2) It is normal for urethane to show signs of stress, especially if ridden on tarmac or other uneven surfaces. This often shows up as thin cracks in the wheel. Such cracks are NOT covered under warranty.
3) Flat spots, indents & general wearing of the urethane are NOT covered under warranty.
4) Any wheel with more than 30% wear or any wheel that is deemed to be intentionally damaged is NOT covered under warranty.
Warranties are non-transferable. Please be aware that any shipping costs involved with returns will be the responsibility of the purchaser. Shipping costs involved in any returned order are the sole responsibility of the purchaser, and are non-refundable. Any unauthorized returned goods, or refused delivery will be charged a 10% re-stocking fee, as well as any shipping charges involved in the return. We do not accept returns after 15 days from delivery. We ship to the address provided, exactly as it was ordered, after that, the responsibility for the product lies in the hands of the carrier.
Any structural damage due to neglect or abuse will not be covered in any warranty. Natural wear and tear is not covered.

Damaged or Defective Items

All manufacturers' defects must be reported within seven days of receiving merchandise. When the damage claim is confirmed, the patron must prepare the merchandise for return shipment. The Vault Pro Scooters will arrange a pickup of all returns on manufacturers' defects, which will be sent directly to the manufacturer. In some cases, we will only need to send the customer replacement parts without having to return the original purchase. This is determined based on written damage claims and photos on a case-by-case basis.
Damage Claim Policy
If it is required for a defective or damaged item to be returned to us, The Vault Pro Scooters will provide the patron with a return label to be placed on the return package. The Vault Pro Scooters is not responsible for any manufacturers’ defects but may facilitate such claims on behalf of our patrons. It is important to understand that product defects are the sole responsibility of the manufacturer and patrons agree to indemnify The Vault Pro Scooters from such claims.
Patrons typically do not need to return the initial merchandise because replacement parts might suffice to fix most damaged or defective problems. If a replacement part is warranted, a new scooter will not be sent under any circumstances. The Vault Pro Scooters will not assume responsibility for any products shipped to us from patrons who have not received authorization from The Vault Pro Scooters. DO NOT send products to The Vault Pro Scooters for returns, refunds, or replacements without first receiving written approval to do so.
Replacement parts and/or scooters are sent through the same shipping process as the initial order. Although we try to quickly process all warranties and damage claims, be advised it can take up to three weeks for the patron to receive replacements from the manufacturer.
For convenience purposes, The Vault Pro Scooters may authorize patrons to have repairs completed at a patrons’ local scooter workshop, if available. The Vault Pro Scooters will then reimburse the patron for all repair expenses only if, the patron provides a receipt or invoice. A representative of The Vault Pro Scooters must approve any such repairs in advance with written approval. Be advised these repairs are subject to review and The Vault Pro Scooters reserves the right to determine legitimacy of such expenses and will only reimburse a reasonable rate for all such parts and services.

The Vault Pro Scooters ships all merchandise via US Postal Service or FedEx. Unfortunately, we do not offer any expedited shipping through our regular checkout pages at this time. Please see below for International Orders.
Almost all orders ship within 1-2 business days of placing your order. Orders are only processed and shipped Monday-Friday during regular business hours. Store hours are as follows: Monday - Friday: 11am - 7pm
Please verify that your shipping address is entered correctly as there is a $15 rerouting fee per package to correct a shipping address after the order has been shipped.
PO Boxes: Yes we’ll ship to your PO box but only via US Postal Service. FedEx will only accept physical addresses. We do not suggest entering a PO box if you are purchasing any large items. (i.e complete scooters, rails, ramps, etc.) If you do enter your PO box for an order with a large item, expect a call or email from one of our representatives who will reach out to retrieve a physical address.
APO/FPO: We are able to ship to APO or FPO boxes however, the shipping rates will not be calculated accordingly in the web checkout. The $7.95 flat rate will be applied as a deposit towards the accurate shipping rate. You will be responsible for the full price of shipping and a representative will be reaching out to you to collect these additional charges. If you are not comfortable with the full shipping rate, we offer a complete refund on these orders.
Non-Contiguous US: We are able to ship to Puerto Rico, Hawaii and Alaska but please note that you will be responsible for the full price of shipping. The $7.95 flat rate will be applied as a deposit towards the accurate shipping rate. A representative will reach out after you have placed the order to collect the additional rate.
Oversized Packages: Please note that all rails, ramps, oversized packages and orders with multiple scooters of 3 or more completes will not apply for the $7.95 flat rate shipping. The shipping rates will not be calculated accordingly in the web checkout and a representative will reach out to collect the full price of shipping after you have placed it.

Introduction
This Terms of Use Agreement (hereinafter “Agreement”), The Vault’s Privacy Policy, and all policies posted on our Site www.thevaultproscooters.com (hereinafter “Site”) set out the terms on which The Vault offers users of the Site access to and use of our products, and services (collectively "Services"). All policies and The Vault’s Privacy Policy are incorporated into this Terms of Use Agreement.
The entity you are contracting with is The Vault Pro Scooters (hereinafter “The Vault”), a California company. The Site is an E-commerce website that sells complete pro scooters, scooter parts, safety equipment, and accessories. The terms “we”, “us”, and “our” also refer to The Vault. The Vault is not liable if it is unable to perform its obligations under this Agreement, due directly or indirectly to the failure of any machine or communication system, industrial dispute, war, Act of God, or anything outside the control of the bank or its servants or agents. The Vault shall not be responsible for any delay in the transmission to the bank of evidence of retail purchases by the participating merchants or any other third party. The Vault reserves the right to vary, delete or add to any of these terms and conditions at any time at its discretion without notice. The Vault’s decision on all matters relating to your use of the Services is final and binding on the member. All information is accurate at the time of printing or posting online.

The Service is controlled, operated and administered by The Vault Pro Scooters from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Placing Orders. After placing an order for a product offered by The Vault on our Site, you authorize us to charge your credit card for the cost of the product. Unless noted, fees are in US dollars; tax is additional. We may refuse purchases, which may place a hold on your account.

Return and Exchanges. All returns and exchanges must be reported to The Vault within 14 days of receiving your merchandise(s). The 14-day period begins when merchandise is delivered. A completed and legible Return/Exchange Goods Form is required for returns. A RMA is also required and can be obtained by contacting one of our customer service representatives by telephone, email or live chat. We can be reached during business hours (M-F: 11am-7pm, Sat: 10am-5pm, Sun: 11am-4pm PST). Return procedures may vary by product, therefore it is important that you contact us for proper authorization and instruction. The Vault will not be held liable for any returns done without proper authorization. Please make sure you include the Return/Exchange Goods Form in the box with your return item(s). The patron is responsible for all shipping charges on any return and/or exchange. Returned items must be in new condition and in its original packaging. A 10% restocking fee will be applied to your return. If the item(s) are damaged, and depending on condition, a 15 - 20% return/restocking fee will be applied. We advise patrons to insure the return with a Signature on Delivery to guarantee the package arrives to its proper destination. The Vault is not responsible for any items lost or damaged during the return shipping process.

Refunds. Refunds are issued within two (2) business days of receiving returned merchandise. Please be patient as it may take several business days for the refund to be transferred into your account. Shipping costs on returns and exchanges are non-refundable.

Termination and Cancellation. You may terminate your account at any time by contacting us at admin@thevaultproscooters.com. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site. From time to time certain members do not comply with the terms and conditions in the Agreement. If we determine, in our sole discretion, that you are not in compliance with the Agreement, we reserve the right to cancel your account.

The Vault reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with The in asserting any available defenses.

Choice of Law and Venue. The Agreement, your access and use of the Site and Services and the relationship between you and The Vault is governed by the laws of the State of California, without giving effect to its conflict of law provisions. The Vault and you both agree to submit to the personal and exclusive jurisdiction of the courts of the State of California. You are responsible for complying with local laws, if and to the extent local laws are applicable. Notwithstanding the foregoing, The Vault shall have the right to commence and prosecute any legal or equitable action or proceeding before any United States or non-United States court of competent jurisdiction to obtain injunctive or other relief in The Vault’s sole discretion.

Miscellaneous Terms. Our relationship is not one of agency or partnership and neither you nor The Vault shall be deemed to be a partner, employee, fiduciary, agent or representative of the other by your use of the Site or our Services. You may not assign or transfer your rights to any third party. The terms and conditions in the Agreement are severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall still be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions. As stated above, the Agreement may be modified only by The Vault posting changes to the Agreement on the Site. This Agreement will inure to the benefit of The Vault’s successors, assigns and licensees. How Your Child Will Use The Vault’s Services
Children seventeen (17) years or younger may create an account on the Site by providing a username, email, and password. Additional personal information that may be collected upon purchase of a product from our Site may include: mailing address, phone number, credit card number, and financial information. Without creating an account, children can browse the E-commerce site which sells complete pro scooters, scooter parts, safety equipment, and accessories. Children may also have access to Communication Services, as defined and referred to section 1.4 of the Terms of Use.
Parental Consent Required
As stated directly above, The Vault may collect personal information from your child, but we need your consent before we collect, use, or disclose the information. We will not collect this information until we have received your consent. You will find instructions on how to give your consent below.
Personal Information We Collect From Your Child
The Vault collects limited personal information. Generally, we collect only online contact information, including your child's name, username, and e-mail address. Depending upon the activities your child chooses to engage in on The Vault, your child may be asked to provide other personal information.
We have worked to adopt this Privacy Policy so children can participate in our Services without giving out unnecessary personal information. We do not require a user to disclose more information than is reasonably necessary to utilize The Vault Site.

Your Use of the Service
Content on the Service
The content on the Service includes videos, audio (for example music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials whether provided by you, YouTube or a third-party (collectively, "Content”).
Content is the responsibility of the person or entity that provides it to the Service. YouTube is under no obligation to host or serve Content. If you see any Content you believe does not comply with this Agreement, including by violating the Community Guidelines or the law, you can report it to us.
Google Accounts and YouTube Channels
You can use parts of the Service, such as browsing and searching for Content, without having a Google account. However, you do need a Google account to use some features. With a Google account, you may be able to like videos, subscribe to channels, create your own YouTube channel, and more. You can follow these instructions to create a Google account.
Creating a YouTube channel will give you access to additional features and functions, such as uploading videos, making comments or creating playlists (where available). Here are some details about how to create your own YouTube channel.
To protect your Google account, keep your password confidential. You should not reuse your Google account password on third-party applications. Learn more about keeping your Google account secure, including what to do if you learn of any unauthorised use of your password or Google account.
Your Information

Permissions and Restrictions
You may access and use the Service as made available to you, as long as you comply with this Agreement and applicable law. You may view or listen to Content for your personal, non-commercial use. You may also show YouTube videos through the embeddable YouTube player.
The following restrictions apply to your use of the Service. You are not allowed to:
- access, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify or otherwise use any part of the Service or any Content except: (a) as expressly authorized by the Service; or (b) with prior written permission from YouTube and, if applicable, the respective rights holders;

Reservation
Using the Service does not give you ownership of or rights to any aspect of the Service, including user names or any other Content posted by others or YouTube.
Changes to the Service
YouTube is constantly changing and improving the Service. We may also need to alter or discontinue the Service, or any part of it, in order to make performance or security improvements, change functionality and features, make changes to comply with law, or prevent illegal activities on or abuse of our systems. These changes may affect all users, some users or even an individual user. Whenever reasonably possible, we will provide notice when we discontinue or make material changes to our Service that will have an adverse impact on the use of our Service. However, you understand and agree that there will be times when we make such changes without notice, such as where we feel we need to take action to improve the security and operability of our Service, prevent abuse, or comply with legal requirements.
Your Content and Conduct
Uploading Content
If you have a YouTube channel, you may be able to upload Content to the Service. You may use your Content to promote your business or artistic enterprise. If you choose to upload Content, you must not submit to the Service any Content that does not comply with this Agreement (including the YouTube Community Guidelines) or the law. For example, the Content you submit must not include third-party intellectual property (such as copyrighted material) unless you have permission from that party or are otherwise legally entitled to do so. You are legally responsible for the Content you submit to the Service. We may use automated systems that analyze your Content to help detect infringement and abuse, such as spam, malware, and illegal content.
Rights you Grant
You retain ownership rights in your Content. However, we do require you to grant certain rights to YouTube and other users of the Service, as described below.
License to YouTube
By providing Content to the Service, you grant to YouTube a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use that Content (including to reproduce, distribute, prepare derivative works, display and perform it) in connection with the Service and YouTube’s (and its successors’ and Affiliates’) business, including for the purpose of promoting and redistributing part or all of the Service.
License to Other Users
You also grant each other user of the Service a worldwide, non-exclusive, royalty-free license to access your Content through the Service, and to use that Content, including to reproduce, distribute, prepare derivative works, display, and perform it, only as enabled by a feature of the Service (such as video playback or embeds). For clarity, this license does not grant any rights or permissions for a user to make use of your Content independent of the Service.
Duration of License
The licenses granted by you continue for a commercially reasonable period of time after you remove or delete your Content from the Service. You understand and agree, however, that YouTube may retain, but not display, distribute, or perform, server copies of your videos that have been removed or deleted.
Removing Your Content
You may remove your Content from the Service at any time. You also have the option to make a copy of your Content before removing it. You must remove your Content if you no longer have the rights required by these terms.
Removal of Content By YouTube
If we reasonably believe that any Content is in breach of this Agreement or may cause harm to YouTube, our users, or third parties, we may remove or take down that Content in our discretion. We will notify you with the reason for our action unless we reasonably believe that to do so: (a) would breach the law or the direction of a legal enforcement authority or would otherwise risk legal liability for YouTube or our Affiliates; (b) would compromise an investigation or the integrity or operation of the Service; or (c) would cause harm to any user, other third party, YouTube or our Affiliates. Copyright Protection
We provide information to help copyright holders manage their intellectual property online in our YouTube Copyright Center. If you believe your copyright has been infringed on the Service, please send us a notice.
We respond to notices of alleged copyright infringement according to the process in our YouTube Copyright Center, where you can also find information about how to resolve a copyright strike. YouTube's policies provide for the termination, in appropriate circumstances, of repeat infringers’ access to the Service.
Account Suspension & Termination
Terminations by You
You may stop using the Service at any time. Follow these instructions to delete the Service from your Google Account, which involves closing your YouTube channel and removing your data. You also have the option to download a copy of your data first.
Terminations and Suspensions by YouTube for Cause
YouTube may suspend or terminate your access, your Google account, or your Google account’s access to all or part of the Service if (a) you materially or repeatedly breach this Agreement; (b) we are required to do so to comply with a legal requirement or a court order; or (c) we believe there has been conduct that creates (or could create) liability or harm to any user, other third party, YouTube or our Affiliates.
Terminations by YouTube for Service Changes
YouTube may terminate your access, or your Google account’s access to all or part of the Service if YouTube believes, in its sole discretion, that provision of the Service to you is no longer commercially viable.
Notice for Termination or Suspension
We will notify you with the reason for termination or suspension by YouTube unless we reasonably believe that to do so: (a) would violate the law or the direction of a legal enforcement authority, or would otherwise risk legal liability for YouTube or our Affiliates; (b) would compromise an investigation or the integrity or operation of the Service; or (c) would cause harm to any user, other third party, YouTube or our Affiliates. Where YouTube is terminating your access for Service changes, where reasonably possible, you will be provided with sufficient time to export your Content from the Service.
Effect of Account Suspension or Termination
If your Google account is terminated or your Google account’s access to the Service is restricted, you may continue using certain aspects of the Service (such as viewing only) without an account, and this Agreement will continue to apply to such use. If you believe your Google account has been terminated in error, you can appeal using this form.
About Software in the Service
Downloadable Software
When the Service requires or includes downloadable software (such as the YouTube Studio application), you give permission for that software to update automatically on your device once a new version or feature is available, subject to your device settings. Unless that software is governed by additional terms which provide a license, YouTube gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by YouTube as part of the Service. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by YouTube, in the manner permitted by this Agreement. You are not allowed to copy, modify, distribute, sell, or lease any part of the software, or to reverse-engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have YouTube’s written permission.
Open Source
Some software used in our Service may be offered under an open source license that we make available to you. There may be provisions in an open source license that expressly override some of these terms, so please be sure to read those licenses.

Warranty Disclaimer
OTHER THAN AS EXPRESSLY STATED IN THIS AGREEMENT OR AS REQUIRED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND YOUTUBE DOES NOT MAKE ANY SPECIFIC COMMITMENTS OR WARRANTIES ABOUT THE SERVICE. FOR EXAMPLE, WE DON’T MAKE ANY WARRANTIES ABOUT: (A) THE CONTENT PROVIDED THROUGH THE SERVICE; (B) THE SPECIFIC FEATURES OF THE SERVICE, OR ITS ACCURACY, RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS; OR (C) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON THE SERVICE.
Limitation of Liability
EXCEPT AS REQUIRED BY APPLICABLE LAW, YOUTUBE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OF PROFITS, REVENUES, BUSINESS OPPORTUNITIES, GOODWILL, OR ANTICIPATED SAVINGS; LOSS OR CORRUPTION OF DATA; INDIRECT OR CONSEQUENTIAL LOSS; PUNITIVE DAMAGES CAUSED BY:
- ERRORS, MISTAKES, OR INACCURACIES ON THE SERVICE;
- PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICE;
- ANY UNAUTHORIZED ACCESS TO OR USE OF THE SERVICE;
- ANY INTERRUPTION OR CESSATION OF THE SERVICE;
- ANY VIRUSES OR MALICIOUS CODE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY;
- ANY CONTENT WHETHER SUBMITTED BY A USER OR YOUTUBE, INCLUDING YOUR USE OF CONTENT; AND/OR

THIS PROVISION APPLIES TO ANY CLAIM, REGARDLESS OF WHETHER THE CLAIM ASSERTED IS BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOUTUBE AND ITS AFFILIATES’ TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF: (A) THE AMOUNT OF REVENUE THAT YOUTUBE HAS PAID TO YOU FROM YOUR USE OF THE SERVICE IN THE 12 MONTHS BEFORE THE DATE OF YOUR NOTICE, IN WRITING TO YOUTUBE, OF THE CLAIM AND (B) USD $500.
Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless YouTube, its Affiliates, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of the Service.
Third-Party Links
The Service may contain links to third-party websites and online services that are not owned or controlled by YouTube. YouTube has no control over, and assumes no responsibility for, such websites and online services. Be aware when you leave the Service; we suggest you read the terms and privacy policy of each third-party website and online service that you visit.
About this Agreement
Modifying this Agreement
We may modify this Agreement, for example, to reflect changes to our Service or for legal, regulatory, or security reasons. YouTube will provide reasonable advance notice of any material modifications to this Agreement and the opportunity to review them except that, where legally permitted, modifications addressing newly available features of the Service or modifications made for legal reasons may be effective immediately without notice. Modifications to this Agreement will only apply going forward. If you do not agree to the modified terms, you should remove any Content you have uploaded and discontinue your use of the Service.
Continuation of this Agreement
If your use of the Service ends, the following terms of this Agreement will continue to apply to you: “Other Legal Terms”, “About This Agreement”, and the licenses granted by you will continue as described under “Duration of License”.
Severance
If it turns out that a particular term of this Agreement is not enforceable for any reason, this will not affect any other terms.
No Waiver
If you fail to comply with this Agreement and we do not take immediate action, this does not mean that we are giving up any rights that we may have (such as the right to take action in the future).
Interpretation
In these terms, “include” or “including” means “including but not limited to,” and any examples we give are for illustrative purposes.
Governing Law
All claims arising out of or relating to these terms or the Service will be governed by California law, except California’s conflict of laws rules, and will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA. You and YouTube consent to personal jurisdiction in those courts.
